Shariatpur judicial magistrate summoned
The High Court yesterday summoned Shariatpur's Additional Chief Judicial Magistrate Mohammad Nezam Uddin, directing him to appear before it on March 29 for recording confessional statements of three accused in a murder case at the same time in violation of law.
Nezam Uddin has been ordered to appear before the HC bench of Justice Obaidul Hassan and Justice AKM Zahirul Huq to place his explanation on this issue.
The bench issued the order on a suomuto (voluntary) move during hearing a petition filed by two accused -- Litan Sunny and Ali Hossain Bepari -- seeking bail. The bench granted them six months' bail in the case.
Advocate Sabbir Hamza Chowdhury said Khalil Fakir, a van driver, was hacked to death at Jajira in Shariatpurt and a case was filed against two persons on July 5, 2018.
Later, Rubel Chaukidar, Litan and Bepari were implicated in the case's charge sheet. Nezam Uddin recorded confessional statements of the three at the same time from 12am to 3pm on July 19, 2018 in violation of section 164 of the CrPC, he said.
As per section 164 of the CrPC, the magistrate concerned must give at least three hours' time to an accused to give confessional statements after they are produced before the magistrate, but Nezam Uddin did not follow the procedure.
Rubel, Litan and Bepari are now in Shariatpur jail, Hamza added.
