Mainul sent to jail illegally: SCBA secy
Supreme Court Bar Association (SCBA) Secretary AM Mahbub Uddin Khokon yesterday demanded that the chief justice immediately withdraw judicial powers of Magistrate Mohammad Tofazzal Hossain and take punitive action against him for sending Barrister Mainul Hosein to jail.
The Dhaka metropolitan magistrate on Wednesday sent former caretaker government adviser Mainul to jail after rejecting his bail petition in a case filed for defaming journalist Masuda Bhatti in October last year.
Yesterday, the SCBA secretary also demanded Mainul’s immediate release.
Mainul, a former SCBA president, has been sent to jail illegally after cancelling his bail, he said. “It is a matter of shame for all lawyers,” Mahbub said at a press conference, organised by SCBA at its auditorium.
“Cancelling his [Mainul] bail in a case filed under the bailable section is shameful and regrettable. SCBA is protesting it,” he added.
He said as a former SCBA president, Mainul appeared before the lower court and prayed for bail as per the SC directive, showing respect to law. “But, he was sent to jail, rejecting his bail prayer. We feel that Mainul was sent to jail on a predetermined order.”
“One day, the judiciary will have to suffer a harsh consequence for the predetermined orders. SCBA hopes that people will be relieved of such directed orders through your [chief justice] necessary steps,” said Mahbub Uddin, also a joint secretary general of BNP. Zainul Abedin, BNP vice chairman and former SCBA president, also spoke at the event.
