Chamber judge passes ‘no order’ on petition
A Supreme Court chamber judge yesterday refused to stay the appointment of Prof Fouzia Rezwan as the principal of Viqarunnisa Noon School and College (VNSC).
Justice Hasan Foez Siddique of the Appellate Division of the SC passed “no order” on a petition filed seeking an order of stay on the appointment of Prof Fouzia.
The apex court judge also sent the petition -- filed by Advocate Eunus Ali Akond -- to its full bench for hearing on October 21.
Being failed to secure a stay order from the High Court on the appointment of Fouzia, Advocate Eunus submitted the stay petition to the Appellate Division on Wednesday.
The petition said the governing body of VNSC is the authority to appoint its principal as per relevant regulations, while the government has authority to appoint teachers.
But the government illegally appointed Fouzia as principal of the institution on September 15, although it has no jurisdiction to do so, Akond said in the petition.
Attorney General Mahbubey Alam appeared for the government.
Following a writ petition filed by him, the HC on September 17 issued a rule asking the government to explain in four weeks why the appointment of Prof Fouzia as principal of VNSC should not be declared illegal.
The HC also cleared the way for Fouzia to join her post by lifting its earlier stay order.
Nazneen Ferdous, the previous principal of VNSC, and two other teachers of the institution were removed last year over the death of Aritry Adhikari, a student of the school.
