Govt's stance against constitution: SCBA

The Supreme Court Bar Association (SCBA) yesterday said the government has apparently taken stand against the constitution by going against the High Court verdict that declared illegal the 5th amendment of the constitution.It has taken a stand for illegitimate rulers, military rule and those who captured power in an illegal way by taking a stand against the judgement, SCBA leaders said at an emergency general meeting yesterday. The Bar leaders also urged the chief justice to summon the inspector general of police (IGP) and ask for an explanation for the presence of intelligence men at the courtroom and their interference in court proceedings on Wednesday. The SCBA expressed deep concern, saying the intelligence men's actions are a threat to free deliverance of the verdict and a part of the government's conspiracy to destroy the judiciary. SCBA made the call at yesterday's meeting convened at South Hall of the SCBA to protest the intelligence men's activities as well as Law Minister Barrister Moudud Ahmed's 'contemptuous comment' about the High Court verdict. The Bar leaders welcomed the verdict on the 5th amendment, terming it 'historical'. "The judgement, in one side, projected the proper history of the country and upheld the rule of law and the constitution," said the resolution of the meeting. Condemning Moudud's comment that the verdict was valueless and made to create a sensation, the SCBA leaders said the comment was merely a conspiracy to insult the court and turn the High Court division ineffective. The resolution of the meeting said the attorney general's moving in the court for the government against his previous client is regrettable and an act against the ethics of the legal profession. The SCBA said the attorney general has lost the right to hold his post due to the act. SCBA president Mahbubey Alam presided over the meeting, which was conducted by secretary advocate Enayetur Rahim. Among others who addressed the meeting were Amir-Ul Islam, Rokanuddin Mahmud, Abdul Matin Khasru, ZI Khan Panna, Sahara Khatun, Yusuf Hossain Humayun, MA Halim and Abdul Baset Majumder. The Communist Party of Bangladesh, meanwhile, condemned the presence of intelligence men at the court and their attempt to talk with two judges.
