Tribunal rejects bail of war crime accused Badsha
The International Crimes Tribunal-1 yesterday rejected a bail prayer of Badsha Mia, one of the 19 accused of a case filed for allegedly committing crimes in Cox's Bazar during the 1971 Liberation War.
The two-member tribunal led by Justice Anwarul Haque fixed February 15 for passing next order in the case. Justice Shahinur Islam was on leave yesterday.
Abdus Sattar Palwan, a counsel for Badsha, sought bail saying that Badsha has been in jail for last 19 months without trial. Besides, the prosecution did not brought “any specific charges” against him.
Opposing the petition, Prosecutor Rana Dasgupta, said charges have already been submitted to tribunal and the accused had 'direct involvement” in an action of genocide. So he should not be given bail.
Other 18 accused are: Salamat Ullah Khan, Moulavi Zakaria Sikdar, Rashid Miah, Oli Ahmad, Jalal Uddin alias Jalal Ahmed, Moulavi Nurul Islam, Md Saiful alias Sabul, Momtaz Ahmed, Habibur Rahman alias Habib Munshi, Moulavi Amjad Ali, Abdul Majid, Osman Gani, Abdus Shukkur, Md Zakaria, Moulavi Jalal, Abdul Aziz, Ramiz Hasan and Samsul Haque. All the accused are from Moheshkhali upazila of Cox's Bazar.
Of the 19, Salamat, Nurul Islam, Badsha and Osman Gani are behind bars while Rashid Miah, former BNP lawmaker from Cox's Bazar, is on bail for ill health. The rest are on the run.
The prosecution in March last year pressed 12 charges against them.
