SC asks Moudud to file leave-to-appeal plea by Sept 3
The Supreme Court yesterday asked senior BNP leader Moudud Ahmed to file a leave-to-appeal petition with this court by September 3 challenging a High Court verdict that cleared the way for a lower court to run a land related corruption case against him.
It passed the order during hearing a petition moved by Moudud seeking stay on the HC judgment.
The Anti-Corruption Commission filed the case on December 17, 2013 against Moudud Ahmed and his brother Monjur Ahmed for grabbing government land worth over Tk 300 crore in the capital's Gulshan.
On last September 14, the Senior Special Judge's Court of Dhaka took cognisance of the charges in Moudud's presence. But on June 23, the HC rejected a revision petition filed by Moudud challenging the legality of the lower court order accepting the charges.
ACC's lawyer Khurshid Alam Khan said the lower court cannot proceed with the trial proceedings against Moudud until the SC disposes of his petition.
At present, Moudud is on bail in this case while Monjur is absconding, Khurshid added.
