Judge Faizee finally resigns


Justice Faisal Mahmud Faizee of the High Court division of Supreme Court (SC) who allegedly tampered with his LLB certificate resigned yesterday.

He submitted his resignation letter to Chief Justice Ruhul Amin around 3:00pm. The chief justice is to forward Faizee's resignation letter to President Iajuddin Ahmed through the SC registrar on Sunday.

In the resignation letter, Faizee said, "A vested political quarter has been spreading propaganda against me and they are involved in tarnishing the image of the Supreme Court judges. As a result I had to seek justice from the Supreme Court several times. Under the circumstances, I felt an urge to quit from my post to protect the image of the Supreme Court."

The LLB certificate of Faizee was cancelled at a special meeting of Chittagong University syndicate on March 3 this year. Later, the Chittagong University authorities published a gazette mentioning the names of students whose certificates were cancelled.

Faizee's name was mentioned in the gazette.

Faizee went on leave on March 5.

The chief justice withdrew Faizee from the judiciary and decided not to put him on any bench to uphold the image of the country's judicial system. Faizee could not preside over any case or draw his salary since then but he continued to sit in his chamber.

On March 19, Faizee filed a writ petition with the High Court challenging the legality of the Chittagong University gazette. A bench comprising Justice Shah Abu Naeem Mominur Rahman and Justice Abdul Awal stayed the gazette notification.

The court issued a show-cause notice on the university asking it to reply within two weeks why its decision to cancel the certificate would not be declared illegal.

The university syndicate on March 3 cancelled about 2,000 certificates including those of LLB examinees who passed between 1983 and 1992 on charges of alleged tampering.

In 2004 at the 353rd syndicate meeting, the university decided to cancel certificates of around 2,400 examinees including Faizee on charge of tampering with mark sheets.

Following a case against the university's decision, the university authorities formed a five-member probe body headed by the then pro-vice chancellor Prof Mohammad Shamsuddin on November 9, 2004 to investigate the matter. The report of the probe body was included in the agenda of a special general meeting of the syndicate. The report found more than 2,000 students guilty of tampering with their mark sheets.

The four-party alliance appointed 19 new judges to the High Court on August 23, 2004. Faizee was among them.

The Supreme Court Ainjibi Samity protested the appointments alleging that the judges were appointed on political considerations. The Supreme Court Ainjibi Samity boycotted the court of the appointed 19 judges.
