Prime Minister Khaleda Zia who holds the portfolio of home minister and Housing and Public Works Minister Mirza Abbas have been accused in the case filed by Amela Khatun with the court of Chief Metropolitan Magistrate, Dhaka.

The other accused are Home Secretary Safar Raj Hossain, Rab Director General Abdul Aziz Sarkar, the commanding officer, second-in-command and seven to eight unknown members of Rab-3 and Rubel, vice president of Dhaka city JCD (South).

After recording the statement of Amela, Metropolitan Magistrate Syed Mujibul Haq ordered a judicial enquiry into the matter.

Sumon Ahmed, 21, was killed in a Rab-claimed "encounter" with the anticrime force in Hindupara under Khilgaon Police Station sometime between 9:00pm of May 30 and 5:00am of May 31, the complainant said.

Amela said Sumon left their East Goran house at 8:30pm on May 30 for his workplace Loren International at Barek Plaza in Goran. Some plainclothes Rab men went to his office at about 9:30pm and enquired about his identity.

When Sumon identified himself, the Rab men handcuffed him pointing a gun.

Blindfolding him with a black cloth, the Rab men boarded him in a yellow taxicab along with two of his office assistants in front of hundreds of witnesses, the complainant said.

The complainant came to know the incident from Anis, another employee of Loren International. She was astonished and scared at the arrest as there were no criminal records against Sumon and he was not involved in any criminal activities.

Amela and her husband Abdul Hakim rushed to Khilgaon Police Station and then to Detective Branch office on Minto Road, but did not find their son.

The couple then went to the Rab-3 office at Tikatuli at about 2:30am where they found their son sitting inside a white jeep. As they tried to talk with Sumon, a Rab sepoy scared them away from the Rab office. But they kept on waiting on the nearby footpath.

Then they saw around seven to eight Rab members taking their son out on the same vehicle, and a Rab member asked them to go to Khilgaon Police Station in the morning.

Hakim went to the police station at about 5:00am and found Sumon's body lying in a police van. The body bore cut marks in the forehead, nose, eyebrows and five holes in the chest apparently caused by bullets, the complainant said.

She said the circumstances indicate that the Rab-3 members in connivance with the other accused shot him dead in a pre-planned manner in between 3:00am to 5:00am.

The complainant mentioned that Sumon earlier was an activist of Jubo Dal, youth front of the ruling BNP. He later joined the Awami League-backed Jubo League and became a leader of its ward no. 25 unit.

Sumon participated in the protest programmes of Awami League when a loop was omitted from the original design of Khilgaon flyover. He was injured when police charged baton on the protestors, Amela Khatun said.

On May 6, local JCD leader Rubel threatened him of teaching "a good lesson" when he was distributing leaflets at Shahi mosque after juma prayers, she alleged.

In the complaint, Amela also said that she had learnt Sumon's change of party angered Public Works Minister Mirza Abbas, the local MP who consulted the home minister (prime minister) about the matter.

Amela's counsel Advocate Firojur Rahman Montu explained that the complaint meant the prime minister as she holds the portfolio of home minister.

Following the orders of the two ministers, the other accused forcibly picked Sumon up from his office and killed him brutally, said the complaint.

The complainant said she was compelled to lodge the case with the court as Khilgaon police refused to register the case when she went there after the burial of Sumon and collecting information about the incident and identities of the killers.

Advocates Sahara Khatun, Kamrul Islam, Abdullah Abu, Momtaz Uddin Mehedi and Abdur Rahman moved for the complainant.
